Yeah it really is… I really hope I don’t have to go to small claims over this. I’m going to call my bank once heritage gives me their final answer which is today or tmr, but it’s past the 60 days mark so I don’t think it will go anywhere.

Sounds like you will need to take them to court. Here is to your eventual victory. But ultimately I’m still very sad that this card is now in the hands of a thief and missing from being in your hands. For such a cool card you have searched for for so long to be taken from you is the saddest part.

Regarding small claims court:
This is not financial or legal advice and you should consult an accountant and an attorney.
My opinion on the matter is that you could write this off as a business loss. If you plan on doing thousands, tens of thousands, or hundreds of thousands of dollars in buying or selling at Heritage over your 30-50-year collecting career, then you should not take Heritage to court. Heritage consistently gets very rare and desirable collectibles that are not (or very rarely) auctioned off anywhere else in the world. By taking them to court, you throw away your ability to ever do business with them again. Unlike Discord, Heritage will never lift your permaban.
I know that it may be difficult to see the bigger picture right now given this huge financial loss and traumatic event, but it may be wiser for you and your business to do nothing at all and claim the ~$4,000 loss on your next tax return. This way, you’ll end up seeing the money back indirectly (offsetting some capital gains) while maintaining a working relationship with the largest auction house in the world.

I like the devils advocate and yeah I could definitely offset taxes, but I basically stopped selling in my sole proprietorship (flipping pokemon cards) and basically only doing investments / stock trading now while buying rare collectibles. Yes taking Heritage to small claims would prevent future business with them, but if they won’t even assist with such a miniscule problem I wouldn’t want to do business with them even if they have one of my most wanted cards in their auction block. There are many places such as fanatics/ebay/alt and maybe future companies in the next couple decades that will auction cards.

That sucks man. I feel for ya. I’ve been in a similar situation and it’s a complete pia and very stressful. My situation had nothing to do with collectibles so I have to imagine that adds a lot more stress to the equation.
My only advice is to be as pragmatic about the situation as possible and document everything.
Apparently means nothing. Either they did refuse to get in contact or they didn’t refuse to get in contact. If they did refuse to get in contact, save that in writing (email, chat logs, whatever). It might not help but it certainly can’t hurt.

This is my yearly reminder for everyone to remember that Fedex is terrible. Just absolutely the worst.
This same fiasco happened to me and they didn’t do shit about it. PWCC didn’t do shit about it either. I only got my cards back because a good Samaritan who received my package went out of his way to get it to me. I gave him for 40 bucks for the trouble. A Fedex agent called me a few days later to tell me they couldn’t do anything about it. Yeah, thanks a lot. Someone else did your job for you.
Wow that is really awful, yeah FedEx gets away with so much and its insanity. That trouble must have sucked tremendously and I am happy you were able to recover your cards!

That is a really awful situation. I remember getting a FedEx package that required a signature but they just dropped it off at the door without anyone signing for it. I know that because the tracking showed that it was signed by me but I wasn’t even home. So that just tells me the delivery guy was just being lazy.
Fedex have also delivered package to the wrong house and took a photo of the delivery, but the photo does not match the house.
Can you see who signed for the package or if they took a photo of the delivery? Maybe it got delivered to the wrong address…
Heritage should refund you because PSA never received the package according to their official records. But I guess they are denying responsibility? That’s pretty bad business practice imo.
Yeah it was signed by “GIJO” idk what this means or who that is, but it wasn’t a PSA employee. There aren’t any photos.
They told me that they wouldn’t reimburse me and yes it does not look like they want to help at all. I am quickly running out of options other than taking legal action.
My mind goes to GI Joe when I saw that.
End consumer should not be punished by misdeliveries by FedEx. Auction house should have insurance to cover these circumstances and no reason why they shouldn’t reimburse you. FedEx is also going to deny responsibility because it showed package as being signed and accounted for. What a tricky situation … very sorry about this situation but yeah legal action would be my next step.
You need to be more clear with the facts of the 3 parties involved here and re-escalate to Heritage.
If your “friend” there is truly a friend and not just a customer liaison this should be trivial work for them.
- Did the package actually make it to PSA? You said at first that it was delivered and signed for there by “GIJO”, but then later PSA said it never made it to their location.
- Outline what you believe to have happened to Heritage. You won the auction in December, paid your invoice, and had the card shipped to your PSA vault. You paid for the shipping (and have record of this), but the item was never received.
- It’s now on Heritage to confirm that the item made it to its end destination. They can do this by showing tracking info + GPS coordinates. They will likely at first just tell you that the tracking says it was signed and delivered. However, you have written confirmation from PSA that they never received it (i think?).
- Heritage at this point needs to go to Fedex. They are insured for the full value (that’s why their shipping is so expensive these days) and are the ones who can fix it for you.
If you have all this in writing and they still refuse, then you should explore small claims because the responsible party took your money and never delivered you the end product / service. But this all seems extremely easy for Heritage to check into if you’re clear that the chain of custody for the package seemed to end with Fedex, and they own that Fedex account.
