Unlisted leaf did a video on those. They do look really cool but I was wondering the whole time watching if dude could get in trouble for selling them. He’s not exactly under the radar now that hype man extreme advertised for him.
Those cards actually do break copyright law. Not nessicarily because they’re Pokemon cards, but because of the artwork. They aren’t using their own art, they’re modifying existing artwork. Artwork becomes yours under copyright law as soon as you create it. I’m not entirely sure, but I think a piece of artwork has to be at least 90% from your own mind to be considered yours. This doesn’t fall under the 90%.
They won’t get into trouble unless their business gets too big, Nintendo doesn’t have time to file claims against every artist on the Internet. But considering that some big names have made videos on them, it’s a real concern. I actually sent the original creators of these cards a message over Facebook warning them of this, I never heard back.
None of this is talking about intellectual property, that’s a whole other mess of laws.
"I am selling a picture of this rare Pokemon card. This is only a picture of the card, not the card itself. If you win this auction, I will send you a coupon via eBay messages which you can then use to redeem the picture of the Pokemon card. I will email you a picture of the card via eBay messages.
Proceeds will be used to start a pokemon selling business. I am a passionate pokemon player looking to start a business revolving around selling Pokemon merchandise and sharing my love with others."
