The situation sucks for sure, but I highly doubt you will be getting anywhere close to $25k in compensation. Those sales were during peak hype and the more recent sales are around the 3-4k mark in PSA 10.
Yes, I understand the market volatility, but I didn’t plan to sell at the bottom of the market. I do totally hear you, and I’m mentally prepping for a back and forth with them.
I won’t allow them to force me into a low compensation due to the unfortunate timing of their mistake that happened to coincide with a dip.
It’d be sort of unfair for them to point to the lowest confirmed sales figures, when I could point to the highest. That may be the central point of contention. I think the declared value is fair. It also held a wealth of sentimental value to me, being the very first English Pokémon pack. Only 40.
Oof… I didn’t even realize how much these packs have come down in price! It looks like @Pbali may be right. There was a sale of a PSA 9 for $1,700 on June 28th (https://ebay.us/FNFDQl - confirmed via 130point) and there are several active listings for PSA 10s on eBay: 2 at $5K, one at $8.5K, and one at $12K. PSA hasn’t offered me the amount I feel necessary, and also refuses to send back my pack in its current state (since that would sort of torpedo their grading/quality assurance credibility).
Legal actions have begun, and my attorneys see 3 areas where PSA is violating consumer protection laws in Texas. Appreciate the support, and plan to disclose all info once this nightmare is over. If nothing else, so that people in my position may better navigate through shady business practices.

Interesting in hearing the details once it’s all over. I’m guessing PSA is offering 3,000 or less right now since 10s are available at 5,000. I don’t think getting more than 5,000 is feasible because PSA could literally buy the 10, and replace it with that. The situation sucks and PSA is clearly at fault, but I feel like it would be hard to argue for more than 5,000 due to the current price of the pack.
There are a few things you’re not considering in your quick take on this, but I understand where you’re coming from.
What I can say is once they sent the pack back to me, they put themselves in a completely new legal situation than if they had called me up while it was in their possession.
This will have implications for others, so I’ll be sure to go over the details eventually.
Not sure how much of a case you have, its almost impossible to value something at its old market value. If they have offered you current market value, thats pretty much what it is, especially with things pretty clear in their own language. You are the one having to prove about 20K in damages, which I can’t see happening vs a massive company who has lawyers that deal with this specific area. Always remember that your lawyers get paid either way. Good Luck!
Sorry for the long time between posts. I’ve been out of the States for a bit, and came back to some progress:
PSA hired Alston & Bird (a top law firm) for their defense. My legal team has gone back and forth with them with a moderate amount of success. Our claim includes an accusation of fraudulent concealment as well as theft by conversion.
They have slowly increased their offer for compensation from $4k to $10k as we’ve made our case. This would be for them to avoid trial, and resolve the case before a court battle.
Slowly but surely making it right! I’ll update again once I’m closer to acceptable compensation.
I’m happy to report that as of today, my case with PSA is resolved. And though I’ve agreed to not discuss the details publicly, I’m happy my lawyers were able to successfully take care of this.
Lesson for everyone: If you have the money, don’t settle for a company’s nonsense.

It’s great that you’ve got your case resolved, I’m glad that justice was served in this instance. However, it’s very saddening for everyone who’s not “having the money” that a similar case would probably result in absolutely nothing but taking the loss on their own. PSA should see much more of this kind of resistance on their wrong decisions, on a much broader scale.
