Thatâs good on PSA then, at least thereâs some transparency there. I am not involved in the community in this way and have had no interaction with any of the winners, so I didnât know. Thank you for clarifying.
No worries. I wouldnât make a strong claim like that without evidence. PSA mentioned a few artists, I knew about 2 prior. Itâs just disappointing how a few bad apples ruined it for everyone, including the other AA winners.
Iâd have to read the contract, because ownership of artwork even of copyrighted characters can stay with the artist depending on what the language of the contest contract was. Itâs entirely possible the artists own the rights to the artwork still.
Itâd be nice if someone could dig the contest terms up.
Youâre right however Iâm almost certain that the Pokemon Company would make you give up your right to the art in their contest rules since it involves distribution rights. For them to print your art on a pokemon card and mail it out they would need rights to the art even if they donât profit from it.
Seems like the artist own the work but agree to an open ended contract such that Pokemon can do what it likes with it forever.
âSponsorsâ Rights to Use Artwork: By entering this Contest and submitting your Artwork, you hereby grant to Sponsors a nonexclusive, perpetual, irrevocable, royalty-free, sublicensable, worldwide license to reproduce, distribute, publish, perform, display, modify, translate, create derivative works of, and otherwise use your Artwork, or any portion thereof, in connection with the Contest and for any other advertising or promotional purpose, and to incorporate the Artwork, in whole or in part, into products or other works in any manner, form, media or technology now known or later developed. Sponsors will have no obligation to publish or otherwise use any Artwork you submit. You agree that it is your sole responsibility to obtain all permissions and releases necessary for the grant of the rights contained in this paragraph. You also agree to take, at Sponsorsâ expense, any further action (including, without limitation, execution of affidavits, licenses, and other documents) reasonably requested by Sponsors to effect, perfect, or confirm Sponsorsâ rights set forth above in these Official Rules, including this paragraph. You hereby waive, and agree to waive, any applicable moral rights in and to your video or image in favor of Sponsors. You will not be entitled to compensation for any use by Sponsors, or its agents, licensees or assignees, of your Artwork.â
Anyone have any idea if this thread is still accurate regarding PSA no longer grading Art Academy cards? Looking to potentially purchase a raw Art Academy card and wanted to see if this is still the case.
It would be awesome if they reversed their policy; I have a raw Art Academy Pikachu I have been hanging on to and waiting for PSA to see the light once again. Fingers crossed they open all of these back up to grading
