Problem buying on Ebay

This isnt about a pokemon card, but a yugioh card i bought so if this isnt aloud it can be removed. Bought this card

When i got it this is what it looked like : imgur.com/a/mzq4WnC

The Card was shipped in a plain envelope with toploader or any protection other then a sleeve. This is a copy and paste from my conversations with the seller:

Me: Got the card in the mail, and after looking at it there are 2 creases in it. One goes down the middle through the thunder to the head and the other is by his arm going outwards. Looks like more indents then creases, but you can tell they are there. The card is more towards played condition then near mint like it was described. Let me know what you want to do from here

Them: The card is not in played condition, since it’s listed as near mint, it will have a flat or two otherwise it would be mint. There’s no creases from what i looked at even in the pictures but if there was, it was properly listed. As you see by my feedback; I’m pretty upfront about the condition of the cards, if you don’t agree that’s your opinion but you got exactly what you purchased. I’m sorry there will be no refund; I can give you a discount on another product if interested.

Me: I sent them the picture of the card

Them: This is the picture I took of the card, I don’t see anything anywhere I took 5 pictures of the front. If that “crease” wasn’t there, it would be considered mint. I didn’t list it mint, I listed it near mint. Even the black lining on top is all straight on my pictures, a crease would have not made that possible. He also sent a copy of the picture from the listing

Me: a near mint card only shows minor surface wear around the corners and surface of the card along with a few scratches. Indents and creases automatically make is played, it doesnt matter what the rest of the card looks like. If they were not there when you shipped it then it happened during shipping. You didnt put the card in a top loader, or at least tapped the sleeve to cardboard.

Them: Your opinion on what played or nm or Mint will be different than mine and the next person and the next person. I ship ALL MY CARDS THE SAME WAY, yet you are the only one that has a problem. I mention condition of all my cards, everyone’s happy and agrees but your a professional grader? You bought a USED CARD and enjoy your USED CARD. earlier I said you can have a discount on another card, I take that back. Don’t like dealing with trolls like you. No need to shop at my store anymore. Goodbye

I then opened a case to get a refund and return the card and the next is what happened from there:

Me: Received the card, and there were 2 indents on it as the picture shows. The picture in the description did not show these and said it was near mint. A near mint card does not have indents on it, only minor surface or corner wear. Contacted the seller about it telling them what happened and was told they were not there and that i wasnt getting a refund. I sent a picture pointing out the indents, and was told they didnt list it as mint. The card was sent with no protection in the mail in a plain envelope. I pointed this out, and this is what the seller said “Your opinion on what played or nm or Mint will be different than mine and the next person and the next person. Goodbye”

Them: How about you show the whole conversation? The all my pictures I took a Of the card were posted. You purchased a USED card and you expected it in new condition? I’m sorry but you got exactly what you purchased, there will be no return. If there wasn’t a mark on the card, it would be considered MINT and sold for 2x the value. Like I said, your opinion on what near mint means is different than everybody else’s. You did not get a fake card, nor did you not get what you ordered. You got exactly what you purchased. My description even says if you have any questions or would like any more pictures, please contact me. Sorry but like i said earlier, you purchased a used card. Have a great night. My listings are also listed as “no returns”. You can’t just buy my item, receive it, inspect it to “YOUR STANDARDS” and just send a return, this isn’t Walmart. If you had more questions before purchasing, you should have contacted me
Lastly, check out my pictures and see the condition I sent my card out to you. eBay should inspect my pictures. You could have easily damaged it yourself if it is even damaged. Remember you didn’t purchase a brand new card, you purchased a used card. Have a great night :+1::+1:

Me: If those indents were not there we would not be having this conversion right now. Also, why would you ever send a card without protecting it? Toploaders are 10 cents and it doest cost more to put it in the envelope and mail it.

Them: I send out my cards in protective sleeves and wrapped around thick paper, everyone else loves it but you don’t, I can care less on your opinion on how I do business. My cards have ALWAYS arrived in the same condition as shipped. You just worry about being a customer and I’ll be the seller. You purchased a USED card, and it’s 100% authentic. Goodbye it’s in ebays hands now.

Me: Why in the world would i damage this card just to go through all this? I have better use of my time. You did not protect the card in anyway when you shipped it, that falls on you. Your supposed to protect the card when you pack it to ship out. We will just let ebay settle this

Them: I never said you damaged the card but accidents happen and I’m not responsible what Happens after you receive it. Once again your opinion is irrelevant, everyone else says nicely packed, just because “you” don’t like it doesn’t mean I don’t package it well. I ship every item the same exact way. Never had one person complain about shipping nor that it arrived damaged. I sent you a perfect fine card as my pictures show, what you did with it after is none of my business. I uploaded some pics so you can see how Much of a 1%er you are. You are the only person on my whole eBay that complained. I’m sorry but you don’t get a refund because you don’t like the product, I listed it with no returns.

Sorry for the very long post. I know it said no returns but am i right to request one because the card came like it did? I didnt see the damage in the photos otherwise i would never had bought it. It also looks like this guy sells pokemon cards.

It is the sellers responsibility to handle and package the cards well. Otherwise they can list a mint card and ship their spare played copy and say “sorry what happened in transit happened”.

Not how it works. You have no control over how they package it. If they decide to start a business they should know how to handle their product.

I don’t want to just evaluate the logistics of this because long story short, you are not in the wrong and that seller has terrible customer service.

I’m no eBay judge, but I believe that eBay will force the seller to return the card for you, and if they refuse you get that Thunder Giant for free on top of your cash

Escalate to eBay, you’re definitely in the right to request a return. They will refund you and hit the seller with a nice account strike for not accepting the return.

Get a refund.

As the seller states in neutral review replies regarding his grading issues:
“Didn’t have to be a troll, if you had a problem I would refund instanty”… this is in reply to customers:

“Definitely not LP more on heavy/damage. Pictures did not actually show creases”
“Medium to heavy play, not LP. Pictures didn’t show back damage accurately.”
“Definitely not NM. Closer to medium play. Has wrinkles.”

Just a bad seller it seems… but atleast he will apparently refund.

I wish I had the time to waste on a 17.00 purchase.
Simply open the case or just ignore it. Life’s too short.

Oh. Who’s the seller? Got a link?

Yeah i opened a case, about half of that was him responding to the case being opened. It seems i have to wait until the 26th to escalate to ebay, unless there is a way to do it now that i dont know about. This is a link to the seller

www.ebay.com/usr/arthurmelman?_trksid=p2047675.l2559

Do i have to wait until the case is done to block this person?

Let me save you a lot of time on your next return.

Let’s rewind back to the part where you open the package and notice the dents on it. Take a picture of the dents.

Go to your My eBay page. Find order. Click request return button. Choose “Item is not as described” as reason.

Here’s the body of your return request.

“Item was described as near mint. Item arrived with large indents. Item appears to have been damaged in shipping.”

Attach picture of indents to case.

Submit case.

Ignore all combative/argumentative/complaining messages from seller. If seller doesn’t appear conciliatory and willing to accept refund, ignore all of their messages and wait until you can escalate the case to eBay. eBay will instantly rule in your favor. Wait until you get return label from eBay. Ship the card back. Wait for refund.

All of the above takes about 3 minutes and wastes a lot less of your time.

eBay will sort it out for you just wait and escalate the case no need to argue with him any longer

Looks like its not just you with this problem…
Apparently he refunds “instanty”?

I like how he talks about the 5 pictures he took as if the other 4 show anything different from the first, which is basically nothing with that trash lighting lol. Easy refund.

Pro advice, listen to this man!

As above, but I understand people come on here for a bit of moral support that their thoughts are not unreasonable. Even on a lower value card.

Most sellers in a situation like this always argue the case, otherwise they would have noted the crease and listed it differently. Once you have experienced this several times you will follow the above points everytime. The chat really doesnt matter and just wastes your time, also just prolongs the inevitable. Ebay will accept the case, return it tracked with their label and get your refund

This isn’t related to the above necessarily but what I would say as a seller on Ebay is that if a card arrives with dents then this could have happened in transit(or the seller has poorly described the condition but I’m focusing on the transit damage here) I had a buyer open a ‘Not as described’ claim against me without sending me any messages first to discuss. Once the case was open it was incredibly difficult to get Ebay to acknowledge it was damaged in transit as unless it is opened as ‘damaged in transit’ they aren’t going to freely refund both parties.

Luckily, I had video proof that the card did not have dents in when sent. The card was sent well packaged in sleeve, toploader and between cardboard but something heavy had obviously been left on it at GSP and dented the card. I’ve no doubt that if I didn’t manage to speak to the buyer over Whatsapp and ask him to contact Ebay to change the claim then Ebay would never have refunded me and I’d have been out of pocket for something that wasn’t my fault.

Obviously the seller above is massively lacking in service skills but just something to bear in mind when opening cases against sellers. Always contact first to discuss issues

Best response this thread has received, well said!

As I’ve said above however, I’d always advise buyers to contact the seller first rather than just open claims straight away as it may not actually be the sellers fault and it makes it very hard for a seller to claim back damage. Obviously this seller is refusing to be reasonable so fair enough.

Yeah had i known it would have gone this far i would have just opened a case and be done with it. I usually send a message first and this is the first time things went south. Every other time the sellers have worked with me to resolve an issue.
