In court you would most likely win. On eBuyer, I am not sure.
I would strongly argue: you sent a sealed case, the case is not sealed anymore because of the buyer. The buyer chose to open the item. Therefore the item is not what you shipped to him and the culpability is with the buyer. Moreover, from what you have shared, there is nothing discernible that the item was not accurately described. In fact the only reason the item is not what you stated is 100% because of the buyers choice to open the sealed case.
Get on the phone with ebay and emphasize these points. The fact they are accusing you of foul play with no evidence should be mentioned as well.
This is more than a buyers remorse situation, this is a manipulative buyer. If this occurred on E4 they would be permabanned.

Honestly, thereâs little you could do different. All info was on the box anyway, and the buyer bought off that info. Maybe I would have added a stock/not included picture of what was inside.
From what i see from your listing there is no problem with how you have described the item. The buyer has interpreted it wrong and in my opinion that should not be enough for them to be able to return the item especially considering it is now unsealed and therefore devalued. I would be looking to give a partial refund at best to cover the value lost from the item being opened personally.
I donât envy the life of sellers sometimes. I guess most of the times its ok. But when it goes wrong my faith in buyers and humanity, in general, is questioned.
I hope you come back with some good news. I really donât understand why they opened the box. It would make sense if it was an expensive booster case where thereâs not much of a premium involved and they wanted to verify the contents, but in this case thereâs just too much value lost.
Itâs written crystal clear whatâs inside the box and your description was spot on as well. We all know youâre right and as Scott said you would win in court, but winning a case on ebay is a different story.
I called to complain it was exactly as described and he should have no right to open a case in the first place. Turns out the package arrived a day later than eBayâs estimated delivery time so it wasnât as described and voids my no return policy. The eBay rep said I will have to try and work it out with the customer for a partial refund.
Also when messaging with the customer back and forth I got fed up and told him we will need to escalate the case and have eBay step in. Well according to the eBay rep they have an automated system that detects in the messages if the seller wants to accept the return. When I told him I wanted eBay to step in this triggered the automated system saying I was willing to accept the refund. Now the case has moved to where I only have the option to create a return shipping label for the customer. I told eBay I wanted them to reopen the case so I could try negotiate a partial refund but he said he canât open it. I will need to try work out a partial refund with the return of the item. But the buyer wants a full refund yet so Iâm not sure what to do. I will have to message him directly to his account to see if I can negotiate something.
So because it was one day late it gives the buyer the ability to ruin the item and send it back to you as a return with a full refund?
They didnât necessarily say that, they just said he was allowed to open a not as described case. They want me to try and resolve the issue with the buyer but Iâm not sure why he wonât reopen the case so we can discuss within the case.
