So about a month ago I won 2 cards in auction from the same seller. He sent them with combined shipping and a single tracking number. When I received the package it only contained one of the cards. Seller ignored all messages, so I opened a “did not receive item” request to which the seller again did not respond, not surprisingly. And today eBay closed the case refusing to refund me because the tracking number showed that I received the package (even though it only contained 1 of the 2 cards I ordered).
Is there anything more I can do or am I just supposed to eat this $50?
I’ve had something exactly happen to me recently and was refunded the amount of the item that was not packaged. Seller did not reply to messages or refund, so I followed it up with ebay. However I did provide 2 pictures. One being all the items I received and the empty parcel spread across a table. And the second being a close up of a custom form that was taped on the parcel, which listed all the items in the envelope, which did not include the missing said item.
Unfortunately, I didn’t have any similar documentation to use as proof. I could have taken photos of the envelop and one card but I really don’t see how photos alone could have proved not receiving the other. I think I’m up a creek with this one.
It’s sad because this seems like a pretty easy scam to pull if this is the way eBay treats this type of case. I actually just sold a 2 card lot this morning, what repercussions would I face for shipping only one of the cards as long as I provide tracking?
Funny how eBay gives sellers little to no backing in legitimate disputes but will protect the dishonest ones in cases of fraudulence.
I’d definitely call them. Once a claim is closed you can have it re-accessed by someone higher up by disputing it. For me this has been handled by a rep in the US who have the control to really look at the case and not just follow the rules laid out for them.
It doesn’t seem like any effort was put in to handle it at all. I actually feel like an idiot for not checking the guys feedback before purchasing but it I was in the heeeeat of the moment when I saw the listing, and like you said it was a relatively inexpensive item. There’s LITERALLY DOZENS of buyers that left negative feedback detailing the exact same situation within the past 6 months, so I’m really curious as to why eBay can’t back me in this case.
Edit: I guess I’m going to give ebay a call later today and see what can be done even though the case is closed. Thanks for the input.
Probably just the way you handled the case. “Item not received” is an open and shut if they have tracking saying it was delivered. However if you opened a case for “item not as described” they can’t just close it on you cause it was delivered.
Basically any claim of non-delivery can be refuted by tracking.
Yes, call them and point out there’s dozens of ebayers who have been ripped by the seller in the same way.

I thought about doing that but it wasn’t a 2 card lot, it was 2 separate single card auctions. The card I didn’t receive had its own individual item number, so I’m opening a case on that single card alone, apart from the one I received. The real complication is that there is a single tracking number shared between two separate item numbers.
If I opened a case for “item not as described”, in the detail section all I could write would be “did not receive item”, because I did not receive any part of that individual item. So it seemed more like a “did not receive” case.
Thanks for the advice everyone, the appeal was made and I’m being refunded. My faith in humanity is somewhat restored and my grapes are no longer sour.
Damn, I recently contacted this seller about PSA 10 Masaki Gengar. Promised to send extra pictures “tomorrow” but I never heard back after that and shortly bought same card from another E4 member.
If I ever order something off Ebay from a seller that has poor rep or no rep or if I’m ordering a high value item, I always video record me opening it. I show the package sealed on all sides, show the label with the tracking number, then record opening it and show my items all in one take. That way if anything like this comes up I have evidence to show Ebay (or Paypal for direct deals).
I just worry about spending $700 on an item, then opening a package to find gravel or something. Because ultimately, if the seller can produce a tracking number showing delivered, you’re often SOL.
